All Articles or Lots Sold "As Is"--Seattle Magpies. and the Consignor assume no risk, liability, or responsibility for the authenticity or the authorship of any property identified in this auction (that is, the identity of the creator or the period, culture, source of origin, as the case may be, with which the creation of any property is identified herein). All property is sold as-is, where-is and neither Seattle Magpies. nor the Consignor make any warranties or representations of any kind, or nature, with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, authenticity, attribution, provenance, age or condition of the property. No statement in the description, made at the sale, on the bill of sale or invoice, or elsewhere, shall be deemed such a warranty or representation or an assumption of liability. While Seattle Magpies will do its best to list any damage, repairs or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items Seattle Magpies sells are antique, vintage or used. You should expect signs of wear consistent with age. Condition reports may be available. All sales are final. No returns, credits or exchanges. Please review all photos carefully prior to bidding.
CONDITIONS TO CANCEL A SALE:
Notwithstanding the preceding condition, if within seven (7) days of the sale of any lot, the purchaser gives notice in writing to Seattle Magpies. that the lot so sold is counterfeit and, if within ten (10) days after such notice the purchaser returns the lot in the same condition as when sold, and proves beyond a reasonable doubt that the returned lot is in fact a counterfeit and that this was not indicated by a fair reading of the catalog, the sale will be rescinded and the purchase price refunded.
RIGHT TO WITHDRAW:
Seattle Magpies. reserves the right to withdraw any property at any time prior to the sale.
AUCTION PROCEDURE:
REGISTRATION
Seattle Magpies. requires each bidder to register online with Auction Ninja before placing any bids. A valid major credit card will be required. By becoming a REGISTERED member you represent that you are of legal age. As a member, you agree to provide true accurate, current and complete information about yourself as prompted by the Site’s registration forms. In addition, as a member, you agree and acknowledge that you will maintain valid credit card info within your membership profile so long as you maintain an account with GES.
Please go to the Auction Ninja website and read carefully the terms of service. That will enable you to have a good bidding experience and answer many questions you have.
ACCEPTANCE OF BIDS
Seattle Magpies. reserves the right to reject a bid from any bidder. Seattle Magpies. will not knowingly accept a bid from the consignor of any lot. Bids placed on the Seattle Magpies website are a binding contract and you are responsible for paying all amounts due to Seattle Magpies including sale price, buyer's premium and all applicable taxes. Please do not bid if you are unable to pay and take possession of the items in the specified time periods for each auction, sale or event. Any items won and not paid for within 24 hours of auction close are eligible for sale to underbidder(s). All sales are final. No returns, credits or exchanges.
PAYMENT AND TITLE TRANSFER
Upon the close of the online auction, title to the offered lot passes to the highest bidder who thereupon (a) assumes full risk and responsibility therefore, and (b) will pay the full purchase price therefore, or such part as Seattle Magpies. may require. Seattle Magpies. is also not responsible for technical issues or loss of internet connection. In cases where your internet connection is lost, Seattle Magpies. will not stop the auction while your internet connection is re-established.
Payment credit cards will be processed within 24 hours of the lot closing, all lots must be paid in full (including buyer’s premium, if applicable) prior to shipping or picking up the lot.
NON-PAYMENT
will result in negative feedback, unpaid item strikes, and being placed on our no-bid list.
Receipt to be Presented to Claim Articles
No article shall be delivered to a purchaser until a paid receipt has been presented. Seattle Magpies. will not make deliveries or purchasers may on request facilitate the employment of carriers and packers for the purchaser's account, however, Seattle Magpies. will not be responsible for their acts in any respect whatsoever.
BUYER’S PREMIUM:A buyer’s premium of 15% will be added to the hammer price in all auctions and will be charged along with the hammer prices and applicable sales tax to the credit or debit card you have on file with Seattle Magpies within 24 hours of the auction end.
SALES TAX: All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information by Seattle Magpies, your future purchases will not be taxed. Tax resale forms can be submitted in your membership profile. Your profile name and address must be the same as your resale certificate. (You must click the Tax Exempt Button located under the Upload Certificate Box to receive the Tax Exempt Status!) BEFORE BIDDING ONLY!
REMOVAL OF PURCHASED MERCHANDISE All purchases must be paid for and removed during the scheduled pick-up time as stated in the auction details. (unless special arrangements are mutually agreed to prior bidding). Once the storage fee exceeds the purchase price of the items the item will be considered forfeited and no refunds will be provided and the bidder being added to our no bid list.
DEFAULT ON SALE If any of the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Seattle Magpies. and to the Consignor by law, including without limitation the right to hold the purchaser liable for the bid price, Seattle Magpies., at its option, may either (a) cancel the sale, retaining as liquidated damage all payments made by the purchaser or (b) resell the property on three days notice to the purchaser and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including warehousing, the expense of both sales, and Seattle Magpies. commission at its regular rates and all other charges due hereunder plus incidental damages.
PAYMENT INFORMATION Upon the close of the online auction, title to the offered lot passes to the highest bidder who thereupon (a) assumes full risk and responsibility therefore, and (b) will pay the full purchase price therefore, or such part as Seattle Magpies. may require. Seattle Magpies at its sole discretion will reoffer the items or donate them to a charity of Seattle Magpies’s choosing. Seattle Magpies reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges. Your membership with Seattle Magpies will be revoked unless past due invoices and any additional charges are paid in full.
SHIPPING INFORMATION:
LOCAL PICK UP ONLY AT THIS TIME. PLEASE BE AWARE OF YOUR LOCAL REGULATIONS regarding the shipping or receipt of ivory, taxidermy and firearms. Seattle Magpies. will not alter packing slips or lot descriptions or the price paid listed on the same. If you choose to bid on an item that is later seized by customs, Seattle Magpies. is not liable for any costs or refunds.
