Terms & Conditions Online Sales

BIDDER RESPONSIBILITIES:
Bidder is responsible for any and all activity, bids, and purchases involving Bidder’s account. Once a bid has been placed, it cannot be lowered or deleted. Bidder agrees to keep its username and password confidential.
CONDITIONS:
By purchasing items offered in a Prestige Estate Services auction, the bidder understands and acknowledges that: (i) Prestige Estate Services, LLC (“PES”) DOES NOT appraise, authenticate, validate, or warranty any items sold, (ii) Bidder hereby expressly waives and releases any and all claims against PES or its employees, owners, or affiliates relating to this sale of property, (iii) Bidder's purchase is a final sale and all items are sold in as-is, where-is condition, (iv) all sales are nonrefundable, nonreturnable, and nonexchangeable, (v) Bidder bears sole responsibility to inspect any purchased items, and (vi) Bidder has had adequate and fair notice of the terms and conditions stated herein.
It is the bidder’s responsibility to determine the exact condition/authenticity of each item. No statement in this catalogue or by representatives of Prestige Estate Services shall be considered as a warranty or assumption of liability. If an item comes with third party authentication or certification, any disputes must be taken up with the authenticator that issued the opinion. PES will do its best to list any damage, repairs, or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items PES sells are antique, vintage, or used. Bidder should expect signs of wear consistent with age. By bidding, you signify that you have either closely examined the item photos, have chosen not to examine the photos, or have hired an independent agent to examine the photo(s) for you. Condition reports are available via the online catalog or by contacting Prestige Estate Services.
BUYERS PREMIUM:
There is a 18% buyer’s premium.
PAYMENT:
All items purchased must be paid for through the Auctionninja payment system (Stripe.com) unless other arrangements have been made prior to winning the auction. Any wire transfer fees will be incurred by the buyer. Sales tax (6%) will be collected from all customers with addresses in the state of Colorado unless you provide us with a copy of your local sales tax number (this must be provided to Auctionninja before you bid, the sales tax can’t be refunded after the close of an auction). Your profile name and address must be the same as your resale certificate.
BIDDING:
All bidding is done via Auctionninja. We cannot place or alter a bid for you. Bids placed on Auctionninja are considered a binding contract and you are responsible for paying all amounts due to PES including sale price, buyer's premium, and all applicable taxes. Please do not bid if you are unable to pay and take possession of the items in the specified time periods for each auction, sale, or event. Any items won and not paid for within 24 hours of auction close are eligible for sale to underbidder(s). All sales are final. No returns, credits, or exchanges.
RESTRICTED MATERIALS:
Please note that lots containing ivory or any other plant or animal material may be subject to regulations imposed by the Endangered Species Act by the United States Fish and Wildlife Department as well as other restrictions under federal, state and/or local law. Some countries prohibit the importation of property containing materials from endangered plant or animal species and prospective purchasers should familiarize themselves with relevant customs regulations prior to bidding if they intend to import these item(s) into another country. We also suggest that bidders in the United States check with their state’s wildlife protection agency for any restrictions on the purchase, possession or sale of ivory or any other animal material. Please note that bidders in New York and New Jersey may not bid on any lots containing elephant ivory, mammoth ivory, or rhinoceros horn. Items containing ivory can only be shipped to an address in the United States. Bidders should check all applicable government wildlife restrictions prior to placing a bid. The buyer will be solely responsible for obtaining any necessary license or permits applicable to the sale or transport of the item(s) including any export or import license and/or certificates as well as any other required documentation.
ESTIMATED WEIGHTS AND MEASUREMENTS:
Metal weight given for jewelry includes stones unless stated otherwise.
CLOCKS AND WATCHES:
No warrantee is given that any clock or watch is in working order. Virtually all clocks and watches have been repaired in the course of their lifetime and may include parts not original to them. There is no guarantee to works or movement. Unless otherwise stated, weight includes works.
ABANDONED PROPERTY:
Any items not paid for and/or not picked up during the specified pick-up time in accordance with the sale’s specific pick-up information will be forfeited by you. PES reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges. Your membership with PES will be revoked unless past due invoices and any additional charges are paid in full. Prestige Estate Services is not obligated to notify the winning bidder of the abandoned lot(s).
PICK-UP:
Successful buyers must pick up their items at the designated sale location within the assigned time frame as stated on the sale details page. We do not offer shipping services. If you require shipping, we encourage you to coordinate with a local pick-up and/or courier service.
If after winning an item you determine you are unable to pick up your items during the scheduled removal times and dates, you must contact PES within 24 hours prior to the pick-up date and we will determine if alternate arrangements can be made. These arrangements will be at the sole discretion of PES and will be subject to transport, labor, and/or storage fees.
RETENTION OF CREDIT CARD INFORMATION:
By providing your credit card information to PES, you authorize PES to charge your credit card for the purchase amount of any successful bid plus the buyer's premium and any applicable taxes. Your card will be charged within 24 hours of auction end. Failure to keep valid credit card information on file will result in your use of the site being terminated. To initiate your ability to bid with PES, an initial $1.00 pre-authorization transaction will appear on your statement. This pending transaction will not settle and will drop off after 5 -7 business days.
You certify that you are an authorized user of this credit card and that you will not dispute the purchase payments with your credit card company provided the transactions correspond to the terms indicated in this authorization outline. PES does not store your credit card information for security reasons.
PROHIBITED USE:
You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from content or materials on the Auctionninja Site. Use of the content and materials for any purpose not expressly permitted in these Terms of Use is prohibited. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Site to a human-perceivable form, except and only to the extent that such activity is expressly permitted by applicable law, and in that case, only if you notify us in writing in advance. You may not copy, frameset, enclose or otherwise distribute any part of the Site.
AUCTION CLOSE:
PES online auctions feature extended bidding (a.k.a. "soft close"). The online, automated system will automatically extend the closing time of a lot (auction item) whenever a bid is placed within the last five minutes of its scheduled closing to allow other interested bidders an opportunity to increase their bid (if they wish to do so). This may occur multiple times on any given lot depending on bidder interest. Once all interest and bidding in a lot cease, the clock will run out and the lot will close.
