By placing a bid, the buyer is affirming both their intent and ability to pay the full amount owed once the auction closes including all applicable taxes and Buyer's Premium. By placing a bid, buyer is affirming they understand these are vehicle which will require immediate mechanical attention and therefore purchase the item knowing full well of the potential costs to make the vehicles completely road worthy from a safety and mechanical perspective. Due to the risk of a buyer being able to reverse the charge on their card once the vehicle is in their possession, the payment must be made in CASH. The buyer agrees to meet the Owner of All Pro Estate Sales, Russell, at an FNBO branch in Fort Collins to allow for a bank team member to verify the amount is paid in full and that no bills are counterfeit. Once the payment is accepted by the banker and deposited directly into the All Pro Estate Sales business account, the signed title and keys will be turned over to the buyer. The buyer and Russell will then depart for the property where the vehicles are located to allow for the buyer to take delivery. As the description of both classic vehicles states, we STRONGLY SUGGEST the buyer to arrange for a flatbed tow service to take the vehicle wherever the new owner decides as both vehicles are exhibiting leaks (and the Galaxy is exhibiting some frustrating shifting and transmission related issues that causes the vehicle to either slip out of gear or find it hard to sink into the proper gear) and we would hate for the buyer to suffer a catastrophic failure of a major component due to overheating or some other unforeseen issue. If the buyer drives the vehicle off the lot, they understand the risk and the fact there are no returns for any reason and these vehicles are being sold without inspection or warranty. The FULL payment must be made by May 28th at 5pm MST.
If the buyer is out of state and sending a moving transport company to collect the vehicle, we will allow for the money to be wired to our business bank account once a separate release is signed and received by our banker to affirm the purchaser understands there is No Warranty and No Refunds.
We kindly ask that the winning bidder establish contact via email @ themrmartin19@gmail.com once the auction concludes so we can begin documenting the process of ensuring you are able to get the vehicle as soon as possible. A Colorado Bill of Sale and Title will of course be provided to the winning bidder after the payment is received by our bank.
If the buyer fails to pay the amount due by May 28th at 5pm, Buyer understands the item will be considered abandoned due to non-payment (severing the responsibility of the Seller to communicate any further with the non-paying bidder or make further attempts to facilitate acceptance of payment and delivery) and the seller reserves the right to re-list the automobile and block the non-paying bidder from the platform for both our auctions and any other company on Auction Ninja. Any buyers who purchase large or heavy items (requiring more than one person) agree to bring sufficient help to remove the item(s) safely. Our staff is not able to assist with moving your items. Buyers agree to the defined pickup times listed on the event page - it is the BUYER'S RESPONSIBILITY to ensure they are available to attend the specific day and time listed. To be fair, the system does a secondary pop-up verification for any buyer when a bid is placed to ensure they understand the pickup terms and the time/date specifications before any bid can be recorded so claiming there was confusion on this important aspect of the process does not void any section of these terms. It is not the responsibility of the Seller to notify or remind any buyer of their responsibility to remove their winning bid items from the auction pickup event. At each pickup event, it is the responsibility of the buyer to verify their order is both complete, accurate and satisfactory by referencing the paper invoice provided by our team. Once a buyer leaves the event, there are not options for refund (including partial refund) for any reason. All buyers must sign our paper invoice for our records relating to any order to prevent any "friendly fraud" instances of chargebacks for items related to the auction. Buyer agrees to forfeit their order with no refund if they fail to collect their item(s) during the defined event day/times OR arrange for an alternate pickup day/time and agree to the applicable service fee (which must be done within 3 hours after the scheduled pickup event ends). Buyer understands that by placing a bid on Auction Ninja for any of our events, they are both affirming their ability to remove any items won on the defined pickup day/date and that any items that remain uncollected for any reason are returned to the Estate with no refund to the buyer. If we have an invoice on file with your account, this means you won items and are obligated to pay our company for the total due regardless whether you pick them up or leave them abandoned.
*** By placing a bid, Buyer agrees to a non-refundable removal fee that will be added as an additional charge to the credit card on file for the abandonment of any large or heavy item ($50 for each item) such as furniture, appliances, etc. If a member of our staff is forced to assist with moving something heavy/large during the pickup event, the buyer agrees to approve a one-time $50.00 transport fee for EACH heavy or large item we assist with and this charge will take place before the items are moved (in addition to signing an invoice for the moving fees). Any buyer who requests an alternate pickup day or time agrees to pay a $50 cash service fee to cover the time and gas it requires to meet outside of the defined pickup event - pickup must take place at the location of the auction event regardless of where the buyer lives. *** Please be aware the discretion of approving any alternate pickup day is not guaranteed and is dependent on seller's availability in which he reserves the right to refuse this option if the service is not possible.
Buyer agrees that the order delivery is complete and satisfactory by removing the items from the auction pickup (the singular exception is that buyers have 24 hours to test electronics). No refunds will be given once the buyer leaves with their items since we are unable to determine with 100% certainty who is at fault for any issue in question.
Any buyers entering the home will have to sign a release AS ALWAYS to ensure that if any damage is caused to the home during transport that the liability for repair cost is assumed by the correct person (I.E. the buyer responsible for safe removal).
Pickup of items is available ONLY on advertised days during advertised times. Please understand that we have limited time for access to the property. Failure to pick up purchased items during advertised pickup times will result in forfeiture of the purchased item(s), ALL SALES ARE FINAL. NO RETURNS, NO CREDIT, OR EXCHANGES. It is the responsibility of the buyer to bring boxes, packing material or other supplies to ensure their items are able to be transported safely - this is especially relevant to large orders or fragile materials or glass/crystal/ceramics. We will have the items ready for pickup but the items will not be boxed or bubble wrapped (which allows for an easy and transparent inspection process for the buyer).

No early bird arrivals will be allowed - no exceptions. The presence of our team on-site does not mean that we offer the ability of early pickups. In some cases we may open the event 15 minutes early but that is at our discretion and should not be an expectation by the buyer.
Shipping is available for this auction for smaller items or any items with the SHIPPING AVAILABLE designation present. If an item is not marked as "Shipping Available", we reserve the right to refuse shipment without refund especially if the buyer has not contacted us directly via email prior to the auction closing to confirm our ability to handle the request. We utilize UPS currently so any buyer must agree to cover the proposed cost of packing, shipping and signature confirm via UPS. The local UPS store will contact each buyer independently once the item(s) for any order are dropped off. Buyer agrees to pay the entire cost - refusal to pay the cost that is quoted by UPS staff will result in forfeiture of the order and no refund will be issued as all items then return to the Estate to dispose of as they see fit. No orders will be dropped off to the UPS until the buyer requesting shipping contacts us via email to verify their intent to be bound by these terms and sign a separate document for our records to ensure any instances of items arriving broken due to transport are handled with UPS directly (the insurer of the package) versus a buyer initiating a chargeback against our company.
Any buyer requiring shipping services agrees to these terms by bidding. If the items are not paid for within 48 hours of the first contact by UPS (phone call to number shown on invoice), the items will be collected from the Store and considered as an abandoned order and entirely forfeited. Our staff normally delivers the order within 72 hours after the end of the defined auction pickup date/time so buyer understands there may be a 2-3 day delay until the items reach the UPS store for processing.
